Board of Adjustment
The Seward County Board of Adjustment is made up of five regular members and one alternate member, with one of the regular members appointed from the Seward County Planning Commission.
The Board hears appeals related to zoning decisions and considers requests for variances when unique circumstances affecting a property would make strict enforcement of zoning regulations create an exceptional hardship. The Board may review and affirm, reverse, or modify certain zoning-related decisions made by administrative officials, interpret zoning maps when required, and grant variances in limited circumstances. Variances are intended to address unusual property conditions such as lot size, shape, topography, or other exceptional circumstances and cannot be granted simply for convenience, financial benefit, or personal preference.
Before granting a variance, the Board must determine that the hardship is unique to the property, that the variance will not substantially harm neighboring properties or change the character of the area, and that granting the request remains consistent with the overall purpose and intent of the County’s zoning regulations. A concurring vote of four Board members is required to approve a variance or overturn an administrative zoning decision.
